RELEASE FOR PHOTOGRAPHIC AND DOCUMENTARY MATERIALS
Thank you for your interest in providing photographic and/or documentary material to SPACES Archives. John Michael Kohler Arts Center, Inc., a Wisconsin nonprofit corporation, stewarding SPACES Archives (“JMKAC/SPACES”), will utilize these materials for educational, programming, preservation, research, and promotional purposes related to its mission of identifying, documenting, and advocating for the preservation of art environments.
TERMS OF RELEASE
I, the undersigned, submit the photographs and/or other documentary material identified on Exhibit A (“Materials”) for the benefit of JMKAC/SPACES with the understanding that:
- None of the Materials will be used for commercialpurposes butrather will be used to further the educational and cultural mission of JMKAC/SPACES to identify, document, collect information about, and advocate for the preservation of art environments and other self-taught artistic endeavors.
- Credit for the photographer will alwaysaccompanyany display or viewing of the Materials on the SPACES website or for any other display, reference, research, or other non-commercial purposes, including publicity, fundraising, educational, or other organizational purposes of JMKAC/SPACES. I understand that Materials displayed on the website are vulnerable to cyber theft and that JMKAC/SPACES is not liable in such instances. The Materials are not hereby released into the public domain.
- Permission of the photographer or the administrator of the photographer’s archives, or their heirs and assignees, must be obtained prior to any proposed commercial use of the Materials.
- Copyrights to the Materialsremainthe sole property of the photographer and/or the photographer’s archives or their heirs and assignees, although JMKAC/SPACES is granted permanent use of all copyrighted Materials submitted by the photographer.
- JMKAC/SPACES shall have the perpetual right to sublicense the Materials for cultural, educational, and other non-commercial uses aligned with the SPACES mission, asdeterminedin good faith by JMKAC/SPACES.
- I also agree and consent to John Michael Kohler Arts Center, Inc. having the right to transfer and assign the Materials to another charitable organization that may in the future steward SPACES Archives and/or promote the mission of SPACES, under the same conditions noted above.
I represent and warrant that I am at least 18 years of age, with full legal capacity and right to execute this release and grant the rights herein granted; that I am the copyright holder, or the authorized representative of the copyright holder, for the photographic and/or documentary material provided to JMKAC/SPACES; and that the Materials do not infringe upon any copyright or other right of any other person.
